How to Apply for an H-1B Visa in the United States
An H-1B visa allows a United States employer to hire a foreign professional for a role that normally requires specialised knowledge and at least a relevant bachelor’s degree, or an equivalent combination of education and experience. Common fields include software engineering, accounting, architecture, data science, medicine, finance, and scientific research.
For an Australian applicant, the process usually begins with finding a US employer willing to sponsor the role. The employer, rather than the worker, handles the main petition with US Citizenship and Immigration Services (USCIS). Because many H-1B applications are subject to an annual quota and electronic selection process, preparation needs to begin well before the intended start date.
Check Whether The Job Qualifies
The position must generally be a “specialty occupation”. This means the normal entry requirement for the job is a degree in a specific field or a closely related discipline. A generic business degree may not support every business analyst position, while a computer science degree is more clearly connected to many software development roles.
Your proposed duties, degree, experience, and the employer’s requirements must align. USCIS may question a petition if the job description is vague, the position appears too broad, or the applicant’s education does not relate closely enough to the work. A role advertised in Sydney as a senior developer may need a much more detailed duties statement when it is presented in an H-1B petition.
The employer must also offer the required wage for the occupation and location. The wage is compared with Department of Labor data for the relevant metropolitan area, such as New York, Seattle, or San Francisco. Australian applicants should check whether the US salary is quoted before or after deductions and remember that benefits, health insurance, and retirement arrangements differ from Australian superannuation.
Find A Sponsoring US Employer
You cannot normally apply for an H-1B visa independently. A US company, university, research organisation, or other qualifying employer must agree to sponsor you. Some employers have established immigration teams and use specialist lawyers, while smaller businesses may need to engage outside counsel and gather substantially more evidence.
Ask prospective employers whether they sponsor H-1B workers, whether the position is subject to the annual cap, and whether they would support an electronic registration. Recruiters on platforms such as LinkedIn and SEEK may describe sponsorship policies, but those statements are not always current. Confirm the position directly with the hiring manager or human resources team.
Some organisations are exempt from the annual numerical cap. These can include universities, affiliated nonprofit entities, nonprofit research organisations, and government research organisations. A cap-exempt role may avoid the regular lottery, although it still requires a properly prepared petition and approval. A job with a private technology company in Melbourne’s US office, for example, may be cap-subject when transferred to a US commercial entity.
Enter The H-1B Selection Process
For a cap-subject position, the employer first creates an online registration during the annual USCIS registration window. The employer provides basic information about the company and the prospective worker, identifies the relevant degree category, and pays the government registration charge applicable to that season. The worker does not submit this registration personally.
USCIS conducts a random selection when registrations exceed the available numbers. The regular quota includes 65,000 places, with an additional 20,000 places for people who hold a qualifying US master’s degree or higher. An Australian university qualification does not normally qualify for the advanced-degree allocation simply because it is a postgraduate degree; the extra category is generally connected to a degree from a qualifying US institution.
Selection does not mean the visa has been approved. It gives the employer an opportunity to file the full Form I-129 petition during the specified filing period. The petition normally includes the job offer, supporting company documents, the applicant’s passport details, academic records, evidence of status if relevant, and the certified Labor Condition Application.
The Labor Condition Application, or LCA, is filed with the US Department of Labor. It confirms that the employer will pay at least the required wage and comply with rules concerning working conditions. The employer must also provide notice of the filing as required. Processing times, filing charges, premium processing availability, and registration rules can change, so employers should verify the current information in official USCIS material and reliable reference material before submitting anything.
Submit The Petition And Visa Application
After selection, the employer files Form I-129 with USCIS. The petition explains the business, the offered position, the work location, the salary, the project or assignment, and your qualifications. If the petition is approved, USCIS issues an approval notice, commonly called Form I-797.
An applicant outside the United States then completes Form DS-160 and pays the applicable visa application fee. You book an interview through the US visa appointment system serving Australia and bring your passport, DS-160 confirmation, appointment confirmation, petition information, approval notice where available, employment letter, résumé, degree documents, and evidence of relevant work experience.
Australians should allow time for appointment availability and administrative processing. Visa services are handled through US diplomatic posts in Australia, and the available location and procedure can vary. Do not assume that a flight from Brisbane or Perth to the United States can be booked immediately after approval; keep the intended employment start date, interview timing, and passport processing period aligned.
At the interview, the consular officer may ask about your employer, duties, qualifications, salary, and plans in the United States. Answer clearly and consistently with the petition. If you are already lawfully in the United States, the employer may instead request a change of status through the petition. In that situation, you may receive H-1B status without immediately obtaining an H-1B visa stamp, but you will generally need a visa stamp before returning after international travel.
Plan Work, Travel, And Family Matters
H-1B status is tied to the sponsoring employer and the approved position. A new employer must generally file a new petition before, or in connection with, changing jobs. Moving to a different worksite can also create compliance issues, especially when the new location falls outside the area described in the LCA.
The initial approval period can be granted for up to three years, with a usual total limit of six years. Extensions beyond six years may be possible in particular green-card circumstances, such as a long-pending employment-based immigrant process. H-1B workers should keep copies of approval notices, pay records, employment letters, and entry documents.
Your spouse and unmarried children under 21 may qualify for H-4 dependent status. Certain H-4 spouses may be eligible for employment authorisation, but this depends on the principal worker’s immigration circumstances and a separate application. Children in H-4 status generally cannot work. These family arrangements should be planned before departure from Australia, particularly if a partner has a job in Sydney, childcare commitments, or professional registration that will not transfer automatically to the United States.
Australians should also compare the H-1B route with the E-3 visa. E-3 is specifically available to Australian citizens in qualifying specialty occupations and is usually not subject to the H-1B lottery. It still requires a US job offer, an LCA, and the relevant qualifications, but it may be a more practical option for an eligible applicant. An immigration lawyer can assess whether E-3, H-1B, an intracompany transfer, or another category best matches the role.
Practical Checks Before Filing
A careful preparation process can reduce delays and prevent an avoidable refusal. Keep digital and paper copies of documents, use consistent job titles and dates, and ask the employer to explain which stage it has reached. American workplace language may differ from Australian usage: “college” can mean university, “resume” usually means CV, and “fall” refers to autumn.
- Confirm that the US employer will sponsor the specific position rather than offering only general future support.
- Match your degree transcripts and employment evidence to the specialist duties in the job description.
- Check whether the employer is cap-subject, cap-exempt, or considering an E-3 application.
- Review the offered salary against the required wage and understand insurance, leave, tax, and retirement deductions.
- Keep your passport valid and prepare certified translations for documents that are not in English.
- Verify current USCIS, Department of Labor, and US visa fees before registration or petition filing.
Australian tax residency, Medicare arrangements, and private health insurance can become relevant when moving to the United States. A person relocating from Adelaide to California may need advice about tax obligations in both countries, while someone taking a short assignment may have a different position. Immigration approval does not automatically settle tax, professional licensing, or employment-law questions.
Begin by discussing sponsorship with the US employer and gathering your qualification and employment records before the next registration period. Check the latest government instructions, keep the employer’s immigration counsel involved, and use the approved petition details consistently through the interview and travel stages.
